EU REGULATION ON THE PROHIBITION OF GOODS FOR CAPITAL PUNISHMENT AND TORTURE

The 30th of July is entering into force the COUNCIL REGULATION (EC) No 1236/2005 of 27 June 2005, concerning trade in certain goods which could be used for capital punishment, torture or other cruel, inhuman or degrading treatment or punishment.
 

The said Regulation puts under control exports and imports in certain goods which could be used not only to inflict cruel tortures or other cruel, inhuman or degrading treatment or punishment, but also for legitimate aims.
 

These controls must be applied to the goods that are used mainly to law enforcement and, unless those controls are shown out of proportion, to any other material or product that can be used illegally to inflict cruel tortures or other cruel, inhuman or degrading treatment or punishment, due to their design and its technical parameters. These products are described in the annex II and III of the Regulation.
